Terms of service.

The agreement between you and SailQuery LLC for use of Niche. Plain English. By creating an account or using Niche you agree to these terms.

1. Who we are

Niche is a service operated by SailQuery LLC (“we”, “us”, “our”). It helps individuals research, draft, and publish editorial content to social platforms. References to “Niche” or “the Service” mean the website at nicheangle.com and all related features and APIs.

2. Eligibility and accounts

Age

You must be at least 16 years old to use Niche. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these terms on your behalf.

One person per account

Accounts are individual. You may not share a single account with multiple people; team and agency seats land in a later plan.

Account security

You are responsible for keeping your sign-in credentials secure and for activity that happens under your account. Niche uses Supabase Auth; we recommend enabling Google or Apple sign-in over reusable passwords.

3. Subscriptions, credits, and billing

Plans

Niche offers three paid plans: Creator ($39/mo), Studio ($99/mo), and Operator ($299/mo). A 3-day trial with 1,500 credits is available without a card.

Credits

Most actions in Niche consume credits. 1 credit equals $0.005 of face value. Each plan includes a monthly credit allotment that resets at the start of each billing cycle. Plan-included credits do not roll over. Top-up packs (5K / 10K / 20K) you purchase separately expire 3 months from purchase.

Reservations and refunds

When you start a run, credits are reserved up front. If a run fails for technical reasons on our side, reserved credits are refunded automatically. If a run completes, consumed credits are not refundable.

Auto-renewal

Paid plans renew automatically at the end of each billing period until cancelled. Cancellations take effect at the end of the current period; you retain access to your plan’s features and remaining credits until then.

Payment processor

Payments are processed by Stripe. We do not store card numbers. Billing changes, payment methods, and invoices are managed through the Stripe Customer Portal accessible from Settings → Usage.

Failed payments

If a renewal payment fails, your account enters a past-due state. We will retry the charge and email you. Premium entitlements (such as Studio’s included modules) may be temporarily locked until the next successful invoice. Account data is retained during this period.

Refund policy

Subscription fees are non-refundable except where required by law. We may grant discretionary refunds for service failures; email support@nicheangle.com to request one.

4. Acceptable use

You agree not to use Niche to:

  • Publish content that violates the rules of any connected platform (LinkedIn, X, Instagram, Substack, or others).
  • Impersonate another person, brand, or organization, or misrepresent your affiliation with one.
  • Publish content that infringes copyright, trademark, or other intellectual-property rights.
  • Publish content that is unlawful, harassing, defamatory, hateful, or sexually explicit involving minors.
  • Generate or publish content designed to mislead voters, manipulate financial markets, or commit fraud.
  • Send unsolicited bulk messages or spam.
  • Probe, scan, or attempt to bypass our authentication, rate limits, or security controls.
  • Reverse-engineer the Service or use it to build a competing product.
  • Use the Service to train, fine-tune, or benchmark a machine-learning model without our written permission.

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity. Egregious violations (CSAM, coordinated fraud) result in immediate termination and may be reported to law enforcement.

5. Your content and publishing

You own your content

You retain ownership of the niche topics, voice samples, brand kits, drafts, and final posts you create with Niche. Niche does not claim ownership of your editorial output.

License to operate the Service

You grant SailQuery LLC a limited, non-exclusive license to store, process, and transmit your content for the purpose of running the Service on your behalf — for example, sending your niche topic to our AI providers, rendering image cards and reels, and publishing approved drafts to platforms you connect.

Drafts are drafts

Niche assists with research and drafting; you are the editor. Generated content may contain factual inaccuracies, outdated references, or inappropriate phrasing. You are responsible for reviewing every draft and for everything you choose to publish under your name.

Explicit publish action

Niche never publishes on your behalf without an explicit Publish action from you. Connected social accounts are used only for the post you approve.

6. Connected social accounts

When you connect LinkedIn or X (Twitter) to Niche, we request only the OAuth scopes required to publish posts you approve. We do not read your follower lists, mentions, inbox, or analytics. Access tokens are encrypted at rest and revocable from Settings → Connected accounts or from the platform’s own security settings.

You are bound by each connected platform’s own terms of service. Niche is not responsible for actions a platform takes against your account (suspension, content removal, rate limits) in response to content you publish through us.

7. AI-assisted drafting

Niche uses large language models from Anthropic and OpenAI, image-generation models from OpenAI and Google, and optional voice synthesis from ElevenLabs to assist with research and drafting. These providers operate Niche’s requests under enterprise-API terms that prohibit using your inputs to train their models. You acknowledge that AI-assisted output is probabilistic and may produce errors. You accept responsibility for verifying facts, citations, and claims before publishing.

8. Service availability

We aim for high availability but do not guarantee uptime. The Service is provided on an “as is” and “as available” basis. We may modify, suspend, or discontinue features with notice. Scheduled maintenance, third-party outages (Supabase, Stripe, Anthropic, OpenAI, social platforms), and force majeure events may interrupt service.

9. Termination

You may cancel your subscription and delete your account at any time. We may suspend or terminate your access for breach of these terms or to protect the Service or other users. On termination, your access ends; your data is deleted according to the retention windows described in the Privacy Policy. Sections that by their nature should survive termination (ownership, disclaimers, liability limits, governing law) will survive.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT GENERATED OUTPUT WILL BE ACCURATE OR FIT FOR YOUR USE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAILQUERY LLC’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, EVEN IF ADVISED OF THE POSSIBILITY.

12. Indemnification

You agree to defend and indemnify SailQuery LLC and its affiliates against claims, damages, and expenses arising out of (a) content you publish through Niche, (b) your breach of these terms or applicable law, or (c) your violation of a third party’s rights.

13. Governing law and disputes

These terms are governed by the laws of the State of Maryland, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Maryland, and you consent to personal jurisdiction there. Nothing in this section limits your right to bring a small-claims action in your local jurisdiction.

14. Changes to these terms

We may update these terms from time to time. Material changes will be posted here and, where appropriate, announced by email. Continued use of Niche after changes take effect constitutes acceptance of the updated terms.
